Please read these terms carefully before using Pharmy's services. By accessing or using our platform, you agree to be bound by these terms.

1. Introduction
Pharmy is a comprehensive Pharmacy Management Software platform designed to streamline pharmacy operations including inventory management, prescription handling, billing, compliance, and analytics.
These Terms & Conditions ("Terms") govern your use of Pharmy's services. By creating an account or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
These Terms are governed by the laws of the United States and any disputes will be resolved in accordance with applicable jurisdiction.
2. Eligibility & User Accounts
Pharmy is intended exclusively for licensed pharmacies, certified pharmacists, and authorized pharmacy personnel. Users must:
- •Be at least 18 years of age
- •Hold valid pharmacy licenses where required by law
- •Provide accurate and complete information during account registration
- •Maintain the confidentiality of account credentials
Pharmacy administrators are responsible for managing access permissions and ensuring that only authorized personnel have access to the system.

4. User Responsibilities
Users agree to:

- •Comply with all applicable local, state, and federal pharmacy regulations
- •Ensure accurate data entry and prescription handling
- •Report any suspected security breaches immediately
- •Not attempt to reverse engineer, copy, or redistribute Pharmy's software
Pharmacies remain solely responsible for compliance with healthcare regulations including HIPAA, controlled substance laws, and prescription dispensing requirements.
5. Payment & Subscription
Pharmy operates on a subscription-based model with the following terms:

Pro:
Multi-branch, AI features, integrations
Enterprise:
Franchise support, advanced reporting
- •Billing cycles: Monthly or annual subscriptions
- •Auto-renewal: Subscriptions renew automatically unless canceled
- •Refunds: No refunds after service activation, except as required by law
- •Taxes: Users are responsible for applicable GST, VAT, or sales taxes
- •Payment failures may result in service suspension
6. Data Handling & Privacy
Pharmy is committed to protecting user data and patient privacy:
- •All data is collected and processed in accordance with our Privacy Policy
- •Sensitive information including prescriptions and patient data is encrypted
- •Users retain ownership of their pharmacy data
- •Data backups are performed daily with secure cloud storage
- •Users remain responsible for HIPAA, GDPR, and local privacy law compliance

7. Intellectual Property
All intellectual property rights in Pharmy, including but not limited to software, designs, trademarks, and content, are owned by Pharmy or its licensors.
Users are granted a limited, non-exclusive, non-transferable license to use Pharmy's services solely for their pharmacy operations. This license does not permit:
- Copying, modifying, or reverse engineering the software
- Distributing or sublicensing the platform to third parties
- Using Pharmy's trademarks or branding without permission
- Creating derivative works based on Pharmy's technology
8. Third-Party Services
Pharmy integrates with various third-party services to enhance functionality:
- Payment processors (Stripe, Razorpay, PayPal)
- Communication services (WhatsApp, SMS providers)
- Cloud storage and backup services
- Analytics and reporting tools
Use of these integrations is subject to the respective third-party terms of service. Pharmy is not responsible for third-party service disruptions or policy changes.
9. Limitations of Liability
Pharmy's liability is limited as follows:
Pharmy is not liable for:
- • Misuse of prescriptions or medical data by pharmacy staff
- • Errors resulting from inaccurate user data entry
- • Service disruptions caused by third-party providers
- • Regulatory compliance failures by pharmacy users
- • Loss of business or profits due to system issues
In no event shall Pharmy's total liability exceed the amount paid by the user for the service in the preceding 12 months.
10. Service Availability & Updates
Pharmy strives to maintain 99.9% uptime but cannot guarantee uninterrupted service due to:
- Scheduled maintenance and updates
- Third-party service dependencies
- Force majeure events beyond our control
- Security incidents requiring immediate response
Pharmy reserves the right to update, modify, or discontinue features with reasonable notice to users.
11. Termination of Services
Pharmy reserves the right to suspend or terminate accounts for:
- Violation of these Terms & Conditions
- Fraudulent or illegal activities
- Non-payment of subscription fees
- Misuse of the platform or security breaches
Users may cancel their subscriptions at any time through their account settings. Upon termination, users have 30 days to export their data before permanent deletion.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Rajasthan, India, without regard to conflict of law principles.
Any disputes arising from these Terms or use of Pharmy's services shall be resolved through binding arbitration in San Francisco, California, or in the federal and state courts located in San Francisco County.
13. Changes to Terms
Pharmy may update these Terms & Conditions periodically to reflect:
- Changes in applicable laws or regulations
- New features or service modifications
- Enhanced security or privacy measures
Users will be notified of significant changes via email or in-app notifications. Continued use of Pharmy after changes constitutes acceptance of the updated Terms.
